ABSTRACTColin Hay's constructivist institutionalism and Vivien A. Schmidt's discursive institutionalism are two recent attempts to theorize ideas as potential explanations of institutional change. This new attention to the causal role of ideas is welcome, but Hay and Schmidt do not take into consideration the constitutive and structural aspects of ideas. Instead they reduce ideas to properties of individual conscious minds, scanting the respects in which ideas are intersubjectively baked into the practices shared by individuals. This aspect of ideas—arguably, the institutional (...) side of ideas—is developed in post-structuralist thought, which therefore demands a place in ideational research. (shrink)

ABSTRACT The technocratic dimension of government—its reliance upon knowledge claims, usually in scientific guise—is of great importance if we wish to understand modern power and governance. In Power Without Knowledge: A Critique of Technocracy, Jeffrey Friedman investigates the often-overlooked question of the relationship between technocratic knowledge/power and ideas. Friedman’s contribution to our understanding of technocracy can therefore be read as a contribution to governmentality studies, one that introduces the possibility of adding normative solutions to this critical tradition.

Colin Hay’s and Vivien Schmidt’s responses to my previous critical engagement with their respective versions of neo-institutionalism raise the issue of how scholars may account for the ideational power of political processes and how ideas may generate both stability and change. Even though Hay, Schmidt, and I share a common philosophical ground in many respects, we nevertheless diverge in our views about how to account for ideational power and for actors’ ability to navigate a social reality that is saturated with (...) structures and meaning. There continues to be a need for an analytical framework that incorporates discourse and a constitutive logic based upon the power in ideas. Post-structural institutionalism (PSI) analyzes discourse as knowledge claims by means of the concept of a constitutive causality, analytically identified in respect to institutions, such that the substantive content of ideas/discourse provides ideational power and generates immanent change. The science of animal consciousness investigates (i) which animal species are conscious (the distribution question) and (ii) how conscious experience differs in detail between species (the quality question). We propose a framework which clearly distinguishes both questions and tackles both of them. This two-tier account distinguishes consciousness along ten dimensions and suggests cognitive capacities which serve as distinct operationalizations for each dimension. The two-tier account achieves three valuable aims: First, it separates strong and weak indicators of the presence of consciousness. (...) Second, these indicators include not only different specific contents but also differences in the way particular contents are processed (by processes of learning, reasoning or abstraction). Third, evidence of consciousness from each dimension can be combined to derive the distinctive multi-dimensional consciousness profile of various species. Thus, the two-tier account shows how the kind of conscious experience of different species can be systematically compared. (shrink)

Four principal papers and a total of 43 peer commentaries on the evolutionary origins of morality. To what extent is human morality the outcome of a continuous development from motives, emotions and social behaviour found in nonhuman animals? Jerome Kagan, Hans Kummer, Peter Railton and others discuss the first principal paper by primatologists Jessica Flack and Frans de Waal. The second paper, by cultural anthropologist Christopher Boehm, synthesizes social science and biological evidence to support his theory of how our hominid (...) ancestors became moral. In the third paper philosopher Elliott Sober and evolutionary biologist David Sloan Wilson argue that an evolutionary understanding of human nature allows sacrifice for others and ultimate desires for another's good. Finally Brian Skyrms argues that game theory based on adaptive dynamics must join the social scientist's use of rational choice and classical game theory to explain cooperation. (shrink)

Solidarity is a fundamental social value in many European countries, though its precise practical and theoretical meaning is disputed. In a health care context, I agree with European writers who take solidarity normatively to mean roughly equal access to effective health care for all. That is, solidarity includes a sense of justice. Given that, I will argue that precision medicine represents a potential weakening of solidarity, albeit not a unique weakening. Precision medicine includes 150 targeted cancer therapies (mostly for metastatic (...) cancer), all of which are extraordinarily expensive. Our critical question: Must a commitment to solidarity as defined mean that all these targeted cancer therapies should be guaranteed to all within each country in the European Union, no matter the cost, no matter the degree of effectiveness? Such a commitment would imply that cancer was ethically special, rightfully commandeering unlimited resources. That in itself would undermine solidarity. I offer multiple examples of how current and future dissemination of these targeted cancer drugs threaten a commitment to solidarity. An alternative is to fund more cancer prevention efforts. However, that too proves a threat to solidarity. Solidarity, with or without a sense of justice, is too abstract a notion to address these challenges. Further, we need to accept that we can only hope to achieve “rough justice” and “supple solidarity.” The precise practical meaning of these notions needs to be worked out through a fair and inclusive process of rational democratic deliberation, which is the real and practical foundation of just solidarity. However, during the 1950s liberal thinking also made use of that work. In line with liberal thinking, Raymond Aron’s “Penser la Guerre, Clausewitz” presents Clausewitz’s work as moderate and liberal and underplays its totalitarian connections.

Cuando se estudian los hitos, modos y autores que han participado en la construcción de una suerte de canon de la poesía colombiana desde comienzos del siglo xx el investigador encuentra en diversas fuentes y a lo largo de las décadas el tópico frecuente de “la cuestión Silva”, entendido como la asimilación paulatina de la obra de José Asunción Silva dentro del canon, su referenciación como un norte pensado desde la modernidad y por tanto como legado de esa modernidad poética (...) a la poesía colombiana de las generaciones posteriores. Este artículo revisita, desde una relectura en la sombra de la obra de José Asunción Silva, ciertos hitos de su recepción relacionados con las diversas y a veces contradictorias maneras como se asumieron en Colombia -y se siguen asumiendo- los conceptos de modernidad, modernismo, simbolismo y decadentismo, y señala críticamente algunas de las referencias textuales y de lectura que tanto la obra como su recepción deben a los tránsitos de otras obras y otras estéticas y poéticas entre Europa y Colombia. The annual cost of healthcare in the United States reached $2.5 trillion in 2009 (about 17.6% of GDP) with projections to 2019 of about $4.5 trillion (about 20% of likely GDP).

John Rawls has held up as a model of public reason the U.S. Supreme Court. I argue that the Dobbs Court is justifiably criticized for failing to respect public reason. First, the entire opinion is governed by an originalist ideological logic almost entirely incongruent with public reason in a liberal, pluralistic, democratic society. Second, Alito’s emphasis on “ordered liberty” seems completely at odds with the “disordered liberty” regarding abortion already evident among the states. Third, describing the embryo/fetus from conception until (...) birth as an “unborn human being” begs the question of the legal status of the embryo/fetus, as if an obiter dictum settled the matter. Fourth, Alito accuses the Roe court of failing to exercise judicial restraint, although Alito argued to overturn Roe in its entirety. In brief, the Dobbs opinion is an illiberal, disingenuous, ideological swamp that swallows up public reason and the reproductive rights of women. (shrink)

This essay uses the global impact of the Coronavirus as a heuristic semiotic for exploring the future of the church. Unlike the pandemic of 1918, which left few dents on the world's economic, social, and cultural systems, almost all the nations of the world have passed laws and implemented procedures that are only comparable to world wars in their impact on entire populations. Nations are acting in unison, but not in unity. This post-COVID, post-Corona world is the 'time that is (...) given' to the church. But it will not be a post-pandemic world. We may become COVID-proof, but we will never be pandemic-proof. There is no pre-COVID reset. There is only risk assessment from natural extinction risks to existential dangers of our own creation that are catching up to us. Disruption is the new status that is never quo; stability is the new abnormality; global cataclysm is the ever-present peril. The only way to prepare for a future of constant 'the end of the world as we know it?' moments is by developing a high Contextual Quotient, and deepening our Contextual Intelligence so we can choose 'the next right thing' in a world of volcanic volatility. CONTRIBUTION: This essay frames the semiotics of a missional ecclesiology in the COVIDian wake from the hermeneutics of blessings not curses. What virtues might we expect to come out of a virus that is fast-forwarding the future, virtues that will shape the contours of Christianity. What if the pandemic is a shock treatment that is putting the world, and the church, back in a new and better equilibrium? What if there are goldmines on the other side of the landmines and minefields? (shrink)

We consider a proportional-prize contest to forecast future events, and show that, in equilibrium, this mechanism possesses perfect forecasting ability for any group size when the contestants share common knowledge about the probabilities by which future events realize. Data gathered in a laboratory experiment confirm the performance invariance to group size. By contrast, when realization probabilities are not common knowledge, there are some differences across group sizes. The mechanism operates marginally better with three or four compared to two players. Philosophical intervention in the dialogue between science and theology: an analysis of the concept of consonance In the last decades, a strong debate on the relationship between science and theology has taken place. In the early 1980, Ernan McMullin introduced the notion of “consonance”, defined as the spontaneous convergence of the conclusions presented by the natural sciences and theology on certain features or properties of the universe. In this paper, I shall try, first and foremost, to carefully look into the (...) meaning that has been attributed to this relationship. Thus, I shall examine the possible implications derived from specific cases of consonance; I shall consider the connection between consonance and truth ; I shall expand on the proposal for a dialogue based on different attitudes regarding consonance ; I shall evaluate the thesis that understands consonance as a cultural construction or an a priori accepted in certain contexts; finally, I shall mention certain variations of this concept, such as strong and weak consonance, or hypothetical consonance. Then, I shall explain the assumptions on which the idea of consonance rests: the unity and intelligibility of reality, the diversity of formal objects and the realism of knowledge. All these assumptions are comprehensive proof of the indispensable intervention of philosophy, as wisdom, in any kind of exchange that occurs between science and theology. And it is only from them that criticism regarding this issue is vested authority. Finally, I suggest a series of critical proposals on the notion of consonance. I shall stress, on the positive side, the opportunity that it offers to move towards a greater disciplinary integration and foster, at the same time, the ordering mission of philosophical wisdom. On the negative side, I shall point out the confusion between religion and theology, the tendency towards a kind of epistemic naturalism of theology, the uncertain creation of the idea of scientific realism and the aspiration to an excessive interference among disciplines. Les parlers poitevins nord-occidentaux (Noirmoutier, Marais nord vendéen) présentent une variation allophonique complexe du vocalisme. On peut distinguer plusieurs niveaux de diphtongaison qui rendent ces variétés particulièrement intéressantes pour l’analyse phonologique. L’étonnante diversité des formes phonétiques en surface peut cependant se réduire à deux grandes catégories de noyaux vocaliques, simples (monophtongues) et complexes (monophtongues longues et diphtongues sous-jacentes). Les premières sont sujettes à des contraintes d’expression liées à l’atérité, ou laxité, tandis que les deuxièmes alternent des voyelles tendues avec des (...) diphtongues décroissantes ou fermantes dans l’oral spontané. Cette contribution traite principalement de comment une enquête sur la structure phonologique d’une variété dialectale peut durer vingt ans, en faisant alterner diverses approches et divers angles de vue sur les données : transcription phonétique, spectrographie acoustique, analyse phonologique tendant à devenir une enquête phonologique amenée à remettre en cause ses prémisses et ses instruments d’observation des faits de parole pour aboutir à une description de la langue. Comparisons of Japan with Western countries have long been used to explore the relationship between technology and culture. In the 1950s and 1960s such work sought to determine if technological imperatives were diminishing cultural differences. In the 1970s, 1980s and early 1990s many sought to identify aspects of Japanese culture that might lie at the root of Japan’s technological successes. This article argues that we should now undertake more micro and more systematic comparative studies that are more directly grounded in (...) theory. Studies concentrating on engineers and the practice of engineering would seem to be an especially promising starting point. (shrink)

The debate around age-based healthcare rationing was precipitated by two books in the late 1980s, one by Daniel Callahan and the other by Norman Daniels. These books ignited a firestorm of criticism, best captured in the claim that any form of age-based healthcare rationing was fundamentally ageist, discriminatory in a morally objectionable sense. That is, the elderly had equal moral worth and an equal right to life as the nonelderly. If an elderly and nonelderly person each had essentially the same (...) medical problem requiring the same medical treatment, then they had an equal right to receive that treatment no matter what the cost of that treatment. Alternatively, if cost was an issue because the benefits of the treatment were too marginal, then both the elderly and nonelderly patients requiring that treatment ought to be denied it. If there were something absolutely scarce about the treatment, then some fair process would have to be used to make an allocation decision. (shrink)

Humans tend to group themselves in communities with similar understandings of the meaning of life and how to act accordingly. For the most part, in past history such large communities, called cultures or civilizations, have tended on the one hand to live unto themselves, and on the other to dominate and, if possible, absorb the other cultures they encountered. For example, Christendom, Islam, China.

This paper argues that there are instances in which tobacco control litigation is strengthening the justiciability of the right to health and health-related rights. This is happening in different parts of the world, but in particular in Latin America. In part this is because, to a certain extent, tobacco control litigation based on fundamental rights overcomes the traditional arguments against economic, social and cultural rights adjudication: the anti-democratic argument, the lack of technical competency argument, the problem of the misallocation of (...) scarce public resources and the problem of the implementation of judicial decisions. As we analyzed in this paper, tobacco control cases based on fundamental rights are allowing courts to elaborate on broader standards of judicial adjudication of social rights, e.g., expand notions of standing, progressive realization, and state obligations enshrined in the right to health. Key to this judicial trend is the Framework Convention on Tobacco Control, which provides a legal standard — supported by scientific evidence — defining concrete measures states should take to address the tobacco epidemic, and thus giving content to the right to health as it relates to tobacco control.
